This document establishes the Standard Contractual Clauses (“SCCs”) in accordance with the General Data Protection Regulation (“GDPR”) to guarantee the legality of international transfers of personal data carried out within the framework of the BeatPillz operation.
1. Parties to the Agreement
BeatPillz acts as data controller, collecting, storing and processing personal data of its users in order to provide its services and ensure compliance with data protection regulations. Users of the platform, whether Sellers or Buyers, accept these Standard Contractual Clauses when using the platform.
2. Definitions and Scope
Personal data includes any information relating to an identified or identifiable natural person, such as names, emails, online identifiers, payment data and other information processed by BeatPillz. Data processing comprises any operation performed on personal data, such as collection, storage, transfer, modification or deletion. International data transfer covers any sending of personal data from an EEA member state to a third country or international organization.
3. Beatpillz's Obligations
BeatPillz will ensure that the transfer of personal data complies with the data protection laws and regulations applicable within the EEA. It will implement appropriate technical and organizational measures to protect the confidentiality, integrity and availability of the personal data transferred. Inform users about the transfer of their personal data and, when necessary, obtain their explicit consent. Monitor and audit service providers' compliance with the obligations set forth in these Standard Contractual Clauses.
4. Users' Obligations
Users must provide truthful and up-to-date information on the platform to ensure the accuracy of the processed data. They are obliged to respect the rules of use of the platform and the established privacy policies. They may not share confidential information of third parties without their consent and must cooperate with BeatPillz in case it is necessary to update, rectify or delete personal information.
5. User Rights
Users may exercise their rights of access, rectification, erasure, objection and data portability in accordance with the GDPR. BeatPillz will provide accessible mechanisms for users to manage their personal data and will respond to requests in accordance with applicable regulations.
6. Liability and Remedies
BeatPillz will be responsible for compliance with data protection regulations and will respond to any incident that compromises information security. Users must immediately report any suspicious activity related to their account to prevent fraud or unauthorized access. In case of complaints, BeatPillz will collaborate with the data protection authorities to ensure compliance with the applicable regulations.
7. Termination of the Agreement and Deletion of Data
These clauses will remain in force as long as the user continues to use BeatPillz's services. When an account is closed, personal data will be deleted or anonymized, unless there is a legal obligation to keep it.
8. Applicable Law and Dispute Resolution
These Standard Contractual Clauses shall be governed by the laws of the country in which BeatPillz has its headquarters within the EEA. Any dispute relating to the application or interpretation of these Clauses shall be resolved by negotiation between the parties and, if no agreement is reached, through the competent courts in the jurisdiction of BeatPillz.
9. Final Provisions
In the event that any provision of these Clauses is declared null and void or inapplicable, the rest of the document shall remain valid. Any modification to these Clauses must be communicated to users and published on the platform. These Clauses shall come into force from the moment the user accepts the terms and conditions of BeatPillz and shall remain in force as long as the user makes use of the platform.
